Terms & Conditions

Placeholders such as <deposit_due> and <overtime_fee> are replaced with the values agreed in your individual quotation/contract.

1. Entire Agreement

This agreement represents the full and complete understanding between AMPLIFIX Mobile DJ and Client. This writing supersedes all prior and simultaneous agreements or understandings, either written or oral, between the parties. In the event that any party to this agreement wishes to alter or amend any of the terms set forth herein, such alterations must be set forth in a written document and signed by all relevant and necessary parties.

2. Client Capacity to Contract

Client affirms that he/she is at least 18 years old and has the legal capacity to enter into a contract with AMPLIFIX Mobile DJ.

3. Deposit

Upon client's signature AND receipt of the deposit fee of <deposit_due>, AMPLIFIX Mobile DJ will reserve the time and date agreed upon above. For this reason, the deposit of <deposit_due> is non-refundable, even if the date is changed or the event is cancelled for any reason, including an act of God, fire, extreme weather, and/or any other reason beyond either parties control. The deposit is to be paid at the time of signing this contract. The deposit is applied towards the total contracted amount. Deposit payment can not be transferred between bookings.

If the deposit fee is not received within 7 days of sending a quotation/contract for signing, then we will not be able to guarantee the availability of services quoted for.

4. Payment

The client understands and agrees that the remaining amount is due 14 days prior to the event. Payment shall be made electronically via our website, or as otherwise agreed (such as BACS). Failure to make required payments on the schedule may result in a breach of contract and the client will forfeit event coverage with no refund of monies having previously been paid by the client. If the client cancels the services that are the subject of this contract prior to the service date for any reason, regardless of fault, the entire retainer (deposit) shall be forfeited and will result in the cancellation of this contract by AMPLIFIX Mobile DJ. If the cancellation occurs by client for any reason within two weeks prior to the event date the following cancellation fees will apply:

  • A cancellation fee of not less than 50% of the agreed fee will be due if the cancellation is within fourteen days of the performance.
  • A cancellation fee of not less than 75% of the agreed fee will be due if the cancellation is within seven days of the performance.
  • The whole of the agreed fee will be due if cancellation is within 48 hours of the performance.

If the final balance has not been paid 14 days prior to the event date, then we reserve the right to cancel your booking with no refund of any deposit paid.

5. Mileage

Mileage is charged at £1.00 per mile after 35 miles (including return journey).

6. Event Plan

The client will be responsible for completing and returning an event plan in a timely manner, but not less than 7 days prior to the scheduled service date, to AMPLIFIX Mobile DJ. The role of the event plan is to provide AMPLIFIX Mobile DJ with the necessary information needed to provide satisfactory services on the date requested. Depending on the type of event, there will be different variation of information required (i.e. a wedding booking would require more detailed information than a Corporate Event booking). All event plans are completed via our website and further information on what is required will be communicated with the client.

7. Overtime

Any extension to the agreed timescale will be charged in addition to the booking fee of <overtime_fee> per hour (or part hour), thereafter, which shall be payable in advance before commencement of extended entertainment.

Performance time and overtime are restricted to a maximum of eight hours in a 24 hour period.

8. Setup and Takedown

The client will appreciate that suitable time for venue access, safe installation and dismantling, and safe removal of equipment from the venue is required in addition to performance time. Therefore, the client and venue will allow suitable time for the installation and dismantling, and removal of disco equipment (up to 60 minutes each side of the booking times unless otherwise stated). Please note: AMPLIFIX Mobile DJ shall not be liable for any additional charges levied to the client by the venue in relation to equipment assembly/removal timescales.

Performance area/function room should be unoccupied and free from guests for setup and takedown and must be free from obstacles and fully lit whilst set up and take down are in progress. Access to any loading areas, doors, stairways must be clear when loading and unloading of equipment.

8a. Additional Setup Charge

Where the client requests that AMPLIFIX Mobile DJ set up equipment at an earlier time prior to the actual start of the function, the client acknowledges that a tiered charge may be made for this additional service and that this service will be subject to availability.

8b. Late Access

AMPLIFIX Mobile DJ will not be liable for any refund, in part or whole, where 'we are late accessing the venue and setting up' purely because of earlier events over-running, or where we are prevented from accessing, setting up, or providing our services by the venue management. AMPLIFIX Mobile DJ will not be obligated to provide an extension to the agreed timescale on a pro-rata basis in these circumstances.

8c. Access and Parking

Where the venue does not have its own parking facilities, AMPLIFIX Mobile DJ reserves the right to pass on any additional parking fees for a refund by the client. In accordance with Health and Safety, AMPLIFIX Mobile DJ are unable to work at venues where illegal or hazardous parking is required in order to unload vehicles. This also applies to general health and safety concerns within the venue such as navigating cluttered or unlit stairways and exits.

8d. Winter Performances

The venue management and or client must ensure that all ice and snow is cleared from the entrance and exit to the venue, where AMPLIFIX Mobile DJ staff are to unload and load their vehicles prior to and after performances. Our staff are instructed not to unload or load until the access area is clear to prevent injury or equipment damage.

8e. Space and Power Sharing

Where AMPLIFIX Mobile DJ is engaged to work alongside a band, (or other entertainers) it is the client's responsibility to ensure that adequate space exists within the venue for all entertainers to set up their equipment and that separate power outlets exist.

8f. Upstairs/Basement Loading

Where AMPLIFIX Mobile DJ equipment must be taken into a venue area that is raised above ground level or basement loading with stairs, an additional charge of £35 will be applicable. An Upstairs/Basement charge will be included in your quotation or may be added at a later date upon arrival at the venue. This must be paid before we unload the equipment. If agreement to use a lift in your booked venue to load/unload equipment above ground level or basement, we will waive any Upstairs/Basement charge, providing the lift is in working order. If there is no lift, or the lift is not in safe working order, and it is viewed using stairs is not appropriate, AMPLIFIX Mobile DJ reserves the right to cancel the services being provided without refund. Due to Health & Safety, we are not able to allow Client or their guests to assist with loading and unloading.

9. Playlists and Requests

AMPLIFIX Mobile DJ will accept music lists and requests in advance of functions and will endeavour to play a reasonable number of the clients' chosen requests, provided such requests are submitted in writing before the event. The client also agrees that AMPLIFIX Mobile DJ cannot guarantee the inclusion of any difficult to source, obsolete, or deleted titles either requested at the event or previously notified.

We do not allow guests to MC, Sing Songs, or Make Speeches unless this has been agreed upon prior to the booking confirmation.

10. Venue Obligations

In order to carry out the services contemplated by this contract, AMPLIFIX Mobile DJ must have the full cooperation of the venue where said services are to be rendered. AMPLIFIX Mobile DJ must also be provided with the following equipment at the venue where services will be rendered:

  • an electrical power source containing of a minimum of 2 13A wall-outlet sockets within 5 metres of the DJ location
  • any applicable public entertainment licenses required by law for the venue where services will be rendered

AMPLIFIX Mobile DJ will not be responsible for the above-mentioned items and in the event that these items are not provided by the venue where services will be rendered, AMPLIFIX Mobile DJ shall not be held liable for the inability to provide the services obligated under this contract. It is the client's responsibility, not that of AMPLIFIX Mobile DJ to ensure that the necessary equipment is provided by the venue.

10a. Sound Limiter

The client will inform AMPLIFIX Mobile DJ prior to performance date, confirmation of venue sound limiter installation. Please note AMPLIFIX Mobile DJ reserves the right to decline entertainment at venues with a sound limiter installed. When performing with a live sound limiter, AMPLIFIX Mobile DJ will try our best not to trigger the limiter. Should a limiter be triggered, and no reset key or venue staff available to reset the device, we will not be held responsible for this issue.

10b. Safe Venue Power Supply

The client ensures that they have verified venue power sources are electrically safe and conform to the HSE Electricity at Work Act 1989, and amendments thereafter. Copies of venue Electrical Installation Safety Certificate (Periodic Inspection Report to NIC EIC standards) must be made available upon request by the venue.

10c. Marquee and Outside Venues

Where the event is being held in a marquee, the client will ensure that the work area is dry and protected from wind, rain and direct sunlight and that a minimum of 2 x 13A power sockets are located within 5 metres of this area.

11. Safety & Security

The client agrees to provide adequate supervision of guests and will ensure that venue management adequately supervises customers and or staff on-site premises. Where the function may include guests under the age of 16 years, the client, (or parent) is responsible for the behaviour and safety of any minors attending the venue. The client will provide and maintain adequate adult supervision at all times. AMPLIFIX Mobile DJ will not be liable for the supervision of minors.

Unwarranted abuse or threatening behavior from the client's guests, venue management or venue staff will not be tolerated and will result in the performance being terminated with no refund being given.

12. Public Liability Insurance

AMPLIFIX Mobile DJ agrees to provide proof of Public Liability Insurance and certifications as required by the venue.

13. Licenses

The client confirms that all appropriate licenses as required by law are in force at the time of performance(s).

14. Assignment of This Contract

The services obligated under this contract may not be assigned to any other party without the express written consent of AMPLIFIX Mobile DJ.

15. Limit of Liability

AMPLIFIX Mobile DJ warrants and declares that every effort will be made to provide high-quality entertainment services. In the unlikely event of severe medical, natural, or other emergencies, it may be necessary to retain an alternative service. AMPLIFIX Mobile DJ will make every effort to secure a replacement and/or willing to provide similar entertainment services under this contract. If such a situation should occur and a suitable replacement is not found, responsibility and liability are limited to the return of all payments received under this contract.

16. Severability

In the event that any provision of this agreement is held to be invalid or unenforceable under applicable law, the validity of this agreement as a whole shall not be affected, and the other provisions of the agreement shall remain in full force and effect.

17. Contract Amendments

This contract has been freely negotiated and shall be recognized as the entirety of the agreement. Only those changes or modifications specifically placed in writing, attached, dated and signed by the client and AMPLIFIX Mobile DJ at the time acceptance of such terms shall be recognized as amendments to this contract.

18. Force Majeure

AMPLIFIX Mobile DJ will not be liable for failing to attend a booking, where the reason for non-attendance or late arrival is caused by adverse weather conditions (including snow & flooding), road closure, road traffic accident, vehicle breakdown, fuel shortages, acts of terrorism, industrial action, or other unavoidable circumstances deemed beyond our control.

19. Dispute Resolution

In the event that any controversy arises as a result of this contract, the parties agree that good faith efforts will be made to submit their differences to mediation. This effort shall be a prerequisite to any further action by either party to enforce the terms of this contract. In the event that mediation fails, any differences between the parties shall be submitted to arbitration. Such arbitration shall be the sole forum for any differences between the parties under this contract and shall be adjudicated under the laws of England and Wales. Client may only resolve disputes with AMPLIFIX Mobile DJ on an individual basis and will not bring a claim in a class, consolidated or representative action. Class arbitrations, class actions, private attorney general actions and consolidation with other arbitrations are not allowed.
